Membership Terms and Conditions

 

1.1 Aquilla Health Club
The club is operated by Rembrandt Hotel Ltd (Proprietor)
Registered in England 2815107
Registered office: 11 Thurloe Place, London SW7 2RS

In this agreement, Aquilla Health Club and Wren’s Health Club will be jointly referred to as “The Clubs”

1.2 All joining fees, subscriptions and other receipts shall become the property of the
Proprietor. On cancellation or termination of membership, no refund will be made to the member of any part of the initial joining fee or monthly membership payment.

1.3 It is a condition of acceptance of membership that the member agrees to pay the initial subscription fee and agrees to be bound by the terms of these rules.

2 Payments

2.1 The subscription fee must be paid by the member in monthly instalments payable by direct debit to the Proprietor’s bank from the member’s bank.

2.2 The Proprietor reserves the right to specify or amend (where reasonably necessary) the method by which monthly membership fees shall be paid, for example by bankers standing order or direct debit.

3 Memberships

3.1 Aquilla Health & Fitness and Wren’s Club offer several membership options as detailed in the individual clubs general information booklet.

3.2 The Proprietor reserves the right to reject within its reasonable discretion any application for membership of the club. Applications may be rejected where, for example, the applicant owes money to the Proprietor, or has behaved in an unacceptable way on the Proprietor’s premises.

3.3 Membership is personal to the member at the location for which membership is granted and cannot be transferred. A member may not loan his or her membership card or permit it to be used by anyone else. The Proprietor may assign the benefit of this agreement to any person, firm or company at any time upon giving at least 30 days prior written notice to the member.

4Fees

4.1 The initial subscription fee and the monthly membership fee shall be payable for each class of membership. The club management shall give at least 30 days’ written notice of any changes to monthly charges.

4.2 Administration fees or joining fees may be applicable on the purchase of a membership. These are subject to change and must be paid in full before membership can commence.

5 Admission
5.1 Every member shall be issued a membership card. Members must swipe their card on each visit to the club – failure to do so will mean that the member will not be allowed entry to the club. a nominal charge not exceeding £30 will be made to replace any lost cards to cover the cost of the cards and the proprietor’s administration’s cost.
6 Termination
6.1  The membership of any member may be terminated
a) By the Proprietor
1. Without notice if a member commits or repeated breach of the clubs rules as set out in these terms and conditions or as display on the clubs notice board from time to time.
2. By notice in writing if any payments owing to the club by a member remains unpaid 30 days after the due date for payment.
3. Upon not less than 30 days notice in writing if the Proprietor reasonably suspects that the member is causing undue upset or inconvenience to other club members or the proprietor’s staff.
b) By the Member
1. The member may terminate membership by giving a full calendar month’s notice providing they have completed the initial membership commitment term as detailed in the individual club’s general information booklet. It will be the member’s responsibility to cancel any direct debits concerned.
7 Guest
7.1 Members who introduce guests to the club shall ensure that their guest completes a guest pass and pays the current guest fee as displayed on the club’s notice board.7.2 Guests must always be accompanied by the member that is introducing them, who will then be responsible for their guest’s actions whilst on the club’s premises.7.3 No more than two may be introduced to the club at any one time by the same member. Prior approval may be granted by the club’s manager to admit extra guests.7.4 Guests with a valid guest pass will have the same membership privileges as the member accompanying them.7.5 The club management may reasonably refuse any guest entrance to the club. The guest charges and admission hours may vary from time to time as displayed on the club’s notice board.

8 Dress

8.1 Appropriate dress must be worn at all times within the club. Trainers and t/shirts/ training tops must be worn whilst using the equipment within the gymnasium.

9 Reservations

9.1 All reservations for studio classes may be made one week in advance.

9.2 The management can refuse to book a class or treatment for a member who repeatedly cancels or fails to keep an appointment for services and or programmes.

10 Conduct of Members

10.1 Members and guests are expected to behave in an orderly and lawful manner at all times whilst in the club. Any damage to club property caused by a member or guest, due to negligence or misconduct, shall be paid for by the member or their guest.

10.2 Smoking is strictly forbidden.

10.3 Members and their guests are requested to shower prior to entering the pool, spa, sauna, or steam room area and again upon leaving the sauna/steam area before entering the pool or spa.

10.4 Members or guests may not enter the club under the influence of alcohol or drugs.

11 Disclaimer of Liability

11.1 Neither the proprietor or any of the companies within the Sarova group of companies, or their agents or employee of the owner shall be liable for loss, damage or theft of personal property belonging to a member or any guest occurring on the club’s premises, except where injury, death, loss, damages, or theft is caused by negligence of the proprietor, its employee’s or agents.

11.2 Members and/or guests are advised to undergo a medical examination prior to beginning a physical activity programme. Those with diabetes, heart disease, high or low blood pressure and pregnant women should consult with their doctor to check which of the club’s facilities should not be used.

12 Other

12.1 Members must notify in writing to the club manager of any changes to their name, address or bank details.

12.2 The club management reserve the right to show potential members around the club and allow them to use the club’s facilities on a trial basis from time to time.

12.3 The hours during which the club is open for use by members may change from time to time or for bank holidays, cleaning or decorating. Where possible at least 14 days prior notice will be given to members. Although shorter or no notice may be given in an emergency.

12.4 The club’s management will use its reasonable endeavours to ensure that the club facilities are in working order and available for use by members when the club is open, but there may be occasions when such facilities may either be out of order or not available for reasons beyond the reasonable control of the proprietor. A member’s entitlement to use the club’s faculties is therefore limited to those facilities which are available to use at the time they wish to use the club.

12.5 The club management shall keep the club notice board up to date and members agree to consult it on a regular base. Members that have difficulty reading the club’s notice board should notify the club’s management so alternative notification procedures can be put into place.

12.6 Any dispute or difference that may arise in regard to the interpretation of these rules shall be dealt with at the discretion of the proprietor.

12.7 The proprietor reserves the right to vary. Revoke or add to these rules from time to time within reasonable discretion and upon giving 30 days’ notice to members.

12.8 The failure of the proprietor or a member to enforce any of its rights at any time for any period shall not be construed as a waiver of such rights

13 Children (Aquilla Health & Fitness Club only)
13.1 Children under 16 years of age, living with a guardian who is a club member, and who has a family membership, may use the swimming pool and its facilities. Children must be accompanied by this adult member at all times. This adult member shall be responsible for the conduct and supervision of the child within the club. The hours during which children may be admitted may vary from time to time as displayed on the club’s notice board.
14 Privacy14.1 The Clubs’ Privacy Notice can be read on Sarova Hotels’ Privacy Centre at privacy.sarova.com, This Privacy Notice covers the actions of Sarova Hotels and The Clubs. Sarova Hotels and The Clubs take your privacy seriously and will only use your personal data as set out in this Privacy Notice.

15 Important – Use of Information

15.1 We wish to maximise your comfort and enjoyment of our facilities. Therefore we will require that you please let us know whether you have any health conditions of which you wish us to be aware. These may include infirmity, heart or other conditions that may affect your safety or ability to use our facilities. You will be required to complete a medical questionnaire. By completing this questionnaire you consent to us recording and processing the medical information that you have provided.

15.2 By signing these terms and conditions, you agree to opt-in to receive communications from Sarova Hotels and The Clubs regarding offers and discounts, news and useful information.
